Terms and Conditions of Use

1. Purpose of the service
X-Tract is a tool enabling a user, hereinafter the Operator, to send a location request by SMS to a third party, hereinafter the Participant, so that the latter may voluntarily share their geographic position in real time, without installing a mobile application.
The service is mainly used in the context of events, security, field management or emergency response.
2. Access to the service
Access to the service is provided through the secure interface available at https://app.x-tract.fr
Registration is required in order to use the features of the service. It is carried out using a telephone number, with a one-time code sent by SMS for authentication.
Upon first login, certain information is requested in order to better understand the intended use:
- First name
- Status of the user, participant or organiser
- Number of events organised or attended per year
- Contextual information, such as the number of participants or past circumstances relating to location
This data makes it possible to adapt the service to the intended use, to strengthen security and to improve the overall quality of the user experience.

3. Operation and consent
The service is based on sending an SMS containing a unique link to a consent page. The Participant may accept or refuse to share their position. The service operates only where explicit consent is given.
X-Tract never geolocates a person without their voluntary agreement. The location link is temporary and secure.
4. Obligations of the user
The Operator undertakes to:
- Use the service only in lawful and legitimate contexts that respect privacy
- Refrain from sending abusive, repeated or unsolicited requests
- Respect the rights of the persons contacted
Any fraudulent or unlawful use will result in the immediate suspension of the account and may give rise to legal proceedings.
5. Data collected and protection of privacy
X-Tract collects and processes certain personal data in order to ensure the proper operation of the service, its traceability and its compliance with legal requirements.
Data collected:
- Identity of the user: first name, status, usage information
- Telephone number of the Operator and of the Participant
- Location data, namely GPS coordinates
- Technical data: dates, times, browser, status of requests, response of the Participant
IP addresses appear in the technical logs of our hosting provider and are not recorded in our databases.
Purposes:
- Allow location requests to be sent and positions to be displayed on the map
- Ensure traceability in the event of a dispute or an investigation, for example in the event of a complaint, a security incident or an official request
- Carry out statistical analyses of response times, accuracy of positions, consent rates and actual use of the service
Retention period: data is retained for as long as the account and the organisation to which it relates exist. It is deleted when the account or the organisation is deleted, as well as at the request of the data subjects. Details are set out in the privacy policy.
Security and confidentiality: communications are encrypted in transit and access to data is restricted to authorised persons. The service database is hosted in the European Union. Our hosting and processing providers are listed in the privacy policy.
Your data is neither sold nor transferred for commercial purposes. It is processed on our behalf by technical providers, listed in the privacy policy, which are not entitled to use it for any other purpose.
Rights of data subjects: in accordance with the GDPR, you have a right of access, rectification, objection, erasure or restriction of processing. To exercise these rights, write to contact@x-tract.fr
6. Minors
The creation of an account is reserved for persons of full age.
A location request may concern a participant who is a minor. In such a case, the organiser ensures that they are entitled to search for that person, and the sharing of the position remains subject to a voluntary action carried out from the telephone concerned.
7. Liability
X-Tract makes every effort to provide a reliable, accurate and secure service. Nevertheless, the service is provided as is, without any guarantee of permanent availability.
The Publisher may not be held liable for:
- An error by the Operator in entering the telephone number
- The Participant's refusal to share their position
- Any abusive use of the service by a third party
- Technical limitations relating to the mobile network, to the Participant's device or to the conditions of access to the Internet
X-Tract is a tool to assist with searching. It replaces neither the emergency services nor the safety obligations incumbent on the organiser of an event.
In the event of a technical anomaly or a security incident, we undertake to inform the users concerned as soon as possible.
8. Intellectual property
All of the elements present on the site, namely texts, trademarks, logos, interface, source code and images, are the exclusive property of X-Tract or of its partners, protected by the laws in force.
Any unauthorised reproduction, representation or use is strictly prohibited.
9. Changes to these terms and conditions
X-Tract reserves the right to modify these terms and conditions at any time. In the event of a substantial modification, a notice will be displayed on the site or sent to registered users.
Use of the service after modification constitutes acceptance of the new terms and conditions.
10. Suspension or termination
We reserve the right to suspend or terminate access to the service, without notice, in the event of failure to comply with these terms and conditions, of abusive conduct or of a legal request.
11. Applicable law and disputes
These terms and conditions are governed by French law. In the event of a dispute, an attempt at amicable resolution will be favoured. Failing that, the competent courts will be determined in accordance with the rules of ordinary law.

These terms and conditions are a translation of the French version. In the event of any divergence between the language versions, the French version shall prevail.
